Algemene verkoopvoorwaarden § 1 Contractual scope This terms and conditions for the business connection between the customer and „MEGA-GAY-WORLD“ Licencee: HOT FROG MEDIA B.V. Schiphol Boulevard 127 1118 BG Schiphol The Netherlands support@mega-gay-world.com subsequently abbreviated „MGW“, apply explicitly as amended on the time of ordering. § 2 Offers The offers of MGW are subject to change. By updating the online product offers all previous offers expirate validity. § 3 Accomplishment oft he contract The contract between the customer and MGW accomplishes only by an order of the customer and ist acceptance by MGW. The order oft he customer is effected online by filling out and sending the order form provided by MGW in the internet. MGW accepts the order by delivery of the ordered products. The products cannot be ordered anonymously and will not be delivered to underage persons. In case of unavailability MGW reserves the right to cancel delivery. In this case MGW will directly inform the customer about the unavailability and after consultation with the customer either refund payments already made or deliver another equivalent product or deliver the unavailable product at a later time. § 4 Prices The prices apply to the date of ordering. All stated prices cover the 19% BTW (Sales tax in The Netherlands) regulated by law. § 5 Forwarding costs All DVDs, Magazines, Music-Discs are delivered without forwarding costs. From an order value of 100 Euro, all other products are delivered without forwarding costs as well. For orders up to 100 Euro arise the following forwarding costs: The Netherlands: 6,90 Euro Germany: 6,90 Euro Other countries: 20,00 Euro § 6 Conditions of delivery At the moment MGW only delivers into European countries. The delivery takes place by the TNT Post NL in a neutral package. The customer is responsible fort he correct statement oft he delivery address.In case of non-deliverability MGW reserves ist right to assert the deveolped disadvantage. With proper delivery of the goods to TNT Post NL the risk devolves to the customer. In case of minor changes in appearance and workmanship of an ordered product, MGW is still authorized to deliver it if equivalent. Partial delivery is allowable. MGW reserves the right to deliver great amounts in little packages. MGW appeals to send the ordered goods within one day after ordering. In case of unavailability of one or more products you will be informed via email. Deliveries abroad can have delays out oft he responsibility of MGW. § 7 DVDs All DVDs have the national code 0 (world-wide playable without restriction) or 2 for DVD-players in Great Britain and Europe. Please mind, that DVDs with erotic or pornographic content cannot be played back by Playstations, Nintendos or other paddles. § 8 Return/change of products Due to hygienic reasons all textiles are generally non-returnable. Defective products will only be changed within 14 days. The same apllies for products oft he category: „Toys & more“ MGW generally changes only defective products and then also assumes the forwarding costs for return. Dislike is no cause for return. If you think we delivered you a defective product, please write an email "support@mega-gay-world.com". We then will tell you how and whereto you should send the product. The postal charges fort he return will be assumed by MGW. Deficiently stamped returns will not be accepted and the costs will not be assumed. § 9 Payment By sending the order the purchase price is callable. The total amount consists of the sum of the product prices less sales returns and allowence and plus eventual forwarding costs. Payment takes place either... - by advance payment via bank transfer - by credit card (VISA and Mastercard) - or via the payment ClickandBuy § 10 Data protection Data necessary for the business conection will be saved. MGW warrants that it will not given to third parties. All personal data will be kept totally in confidency. Credit card data will not be saved. § 11 Miscellaneous If any provision or provisions of this agreement shall be held to be invalid, illegal, unenforceable or in conflict with the law, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. Invalid provisions have tob e replaced by provisions that come closest tot he invalid ones regarding the intended commercial interest.
